Federal regulations impact signs on private property

The Federal Highway Administration (FHWA) amended the United States Code to clarify the applicability of the Manual on Uniform Traffic Control Devices (MUTCD) to any road open to public travel. So, what does this mean? If the public travels on property you own or manage, all of your traffic signs and devices must conform to federal regulations.

This includes areas such as:

  • shopping centers
  • office parks
  • residential developments
  • condominiums and apartment complexes
  • entertainment centers
  • hotels
  • hospitals
  • universities

Traffic signs must meet certain requirements related to reflectivity, design, mounting height, and size to ensure road users receive consistent, uniform messages regardless of where they travel. Providing appropriate traffic signage promotes safety for our pedestrians and motorists. Without proper signage, you could be held responsible for accidents and injuries that occur on your property.
